ICSID case brought against Rwanda

According to the International Center for Settlement of Investment Disputes a new case has been registered against Republic of Rwanda on June 22nd. The case was filed by Bay View Group LLC and The Spalena Company LLC both of which are American companies. The dispute concerns a mining concession and is brought against the state based on the Bilateral Investment Treaty signed between Rwanda and the United States of America in 2008. The applicable rules are the ICSID arbitration rules.

It is to be recalled that Rwandan government has so far cancelled nine mineral exploration and exploitation concessions on grounds that the investors have breached the agreements from 2011 to 2015.

According to the East African “the concession licence of Bay View Group was cancelled after they failed to meet the contractual obligation to invest the agreed amount to increase production” and because “they also failed to adhere to the strict environment regulation by polluting the environment.”

The claimants are represented by Duane Morris LLP. The tribunal is yet to be constituted. More information can be found here.
