Tribunal formed in ICSID case against Kenya
All three arbitrators in an arbitration filed against Kenya at ICSID have been appointed. The case was brought by WalAm Energy Inc, a US/Canadian geothermal company headquartered in Canada. The dispute relates to a geothermal project and was filed in February 2015. The tribunal was constituted on June 2nd 2016.
WalAm Energy Inc appointed Swithin J. MUNYANTWALI Esq., a Ugandan-British lawyer who the Vice Chairman and Co-Founder of theInternational Law Institute African Centre for Legal Excellence (ILI-ACLE) and the Head of Appleton Luff’s East African Office
The Republic of Kenya appointed James SPIGELMAN, AC QC, an Australian national who is the former Chief Justice of the New South Wales and joined One Essex Court, The Temple, London as an arbitrator in 2011.
Joe SMOUHA QC, a British national from Essex Court Chambers was appointed by the Parties as the president of the tribunal.
