Tendai Ndoro: South Africa PSL appeals High Court ruling

The Premier Soccer League is set to appeal the judgement handed down by the South Gauteng High Court relating to the eligibility of former Ajax Cape Town striker Tendai Ndoro.

As earlier reported by KickOff.com, the League’s Executive Committee convened on Thursday to deliberate over the judgement and the way forward.

Judge Denise Fisher on Monday delivered her ruling on the matter which was heard in court last month, and set aside the earlier award of SAFA Arbitrator William Mokhari while further referring Ndoro’s eligibility to the FIFA Players’ Status Committee (PSC).

With discussions having eventually come to a close at 17h00, PSL chairman Irvin Khoza invited the media into the boardroom where the meeting was held to provide an update.

“Where we are with the judgement is that the matter must be directed to FIFA, and for the record it’s important to note that we did go to FIFA at an earlier stage and they gave a ruling on this matter,” said Khoza.

“Again we wrote to FIFA and they gave the second ruling that the matter must be referred to the Disciplinary Committee of the national association, which as you know we did.

“But, again, we are sitting with this kind of decision now which leaves us to ponder as to what the options available to us are as the league.

“Having considered the matter today, we have arrived at a position that the judgement handed down must be appealed.

“The facts and the details must be handed to the board of governors, which will convene next week, for them to ratify what we’ve considered are the reasons why we are appealing.

“We ask for the indulgence of the media and the public that until the board of governors, who are the main shareholders of the business, are given the opportunity to evaluate these reasons before we release it to the greater public and stakeholders.”

Asked whether this appeal, should it be approved by the board of governors, will be heard in the Supreme Court of Appeals or whether it will be taken straight to the Court of Arbitration for Sport, Khoza reiterated that such a decision will be taken in the meeting next week.
